Terms of Service
The agreement between you and Cometamail S.L.: your account, unsend, edit and expiry, plans, free trials and refunds, acceptable use, and your rights as a consumer under Spanish and EU law.
Who we are
Cometamail, including the website at cometamail.com, the web app, our mobile and desktop apps, and the email addresses, storage and features that come with them (together, the “Service”), is provided by Cometamail S.L., a Spanish limited company (sociedad limitada) with its registered office at Carrer de la Pau 18, 46002 València, Spain, tax identification number (CIF) B12345678, registered in the Registro Mercantil de Valencia (“Cometamail”, “we”, “us” or “our”).
These Terms of Service (the “Terms”) form a binding agreement between you and Cometamail S.L. They apply together with our Privacy Policy, our Cookie Policy and our Acceptable Use Policy, which are incorporated into these Terms by reference. If you use a Festival plan, our Data Processing Addendum also forms part of the agreement between your organisation and us. If there is a conflict between these documents, these Terms prevail, except that the Privacy Policy governs how we handle personal data.
In accordance with Law 34/2002 of 11 July on information society services and electronic commerce (“LSSI-CE”), you can contact us by email at legal@cometamail.com for legal matters, help@cometamail.com for support, privacy@cometamail.com for data protection and abuse@cometamail.com to report misuse, or by post at the address above. Our support team in València answers in Spanish, Portuguese or English.
Accepting these Terms
You accept these Terms when you create a Cometamail account and confirm that you agree to them, or, if you use the Service without creating an account, when you first use it. If you do not agree, please do not use the Service. Before you complete registration or a purchase, we make these Terms available to you in a form you can store and print, and after you complete it we send you confirmation of the contract to your email address, in accordance with article 28 of the LSSI-CE and applicable consumer law.
You must be at least 14 years old to create an account, which is the age from which you may consent to the processing of your personal data in Spain under article 7 of Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (“LOPDGDD”). If the law of the country where you live sets a higher minimum age for using a service like ours without parental consent, that age applies. If you are under 18, you may use the free Diamond plan, but you may only buy a paid plan with the consent and involvement of your parent or legal guardian, who will be responsible for payment.
If you use the Service on behalf of a company, public body or other organisation, including as a member or administrator of a Festival plan, you confirm that you have authority to accept these Terms on its behalf, and “you” includes that organisation. An organisation that buys a plan for its business purposes is not a consumer, and the provisions of these Terms that apply only to consumers do not apply to it.
The contract is concluded in English. The current version of these Terms is always available at cometamail.com/terms, and previous versions are available on request from legal@cometamail.com.
The service
Cometamail is an email service. Depending on your plan, it lets you send and receive email from an @cometamail.com address or your own domain; store mail, contacts and files; reel in (unsend) and edit messages after sending; set messages to expire; take back attachments; read conversations as comet threads; import mail from other providers; and block tracking pixels in incoming mail.
We currently offer three plans. Diamond is free and includes one @cometamail.com address, 10 GB of storage, unsend for up to 30 minutes, editing for 24 hours and tracker blocking. Delta includes everything in Diamond, plus unsend for up to 2 hours, expiring messages, taking back attachments, the use of your own domain and 100 GB of storage. Festival is a plan for teams, priced per person, that includes everything in Delta, plus shared inboxes, team expiry policies, an admin console with single sign-on (SSO) and 1 TB of storage per person. The features, limits and prices of each plan are described at cometamail.com/pricing, and the description in force when you buy a plan forms part of your contract.
Storage. Each plan includes the storage stated above. If you approach your limit, we will warn you, and you can delete mail, export it or move to a larger plan. While you are over your limit, you can still read, export and delete your mail, but new incoming messages may be returned to their senders until you are back under the limit.
Import and forwarding. You can import mail, contacts and folders from Gmail, Outlook, iCloud and other providers, and keep your old address forwarding to Cometamail. When you do, you authorise us to access your account with that provider on your behalf, only to copy the data you choose. Your use of that provider remains subject to its own terms, and we are not responsible for the availability or accuracy of the data it supplies.
The Service is funded by the people who pay for it. We do not show advertising on any plan, including Diamond, and we do not fund the free plan by using your mail for any commercial purpose.
From time to time we may offer features marked as “preview” or “early access”, so that you can try them before they are finished. They may change or be withdrawn, they are not covered by the commitments on availability in these Terms, and using them is always optional. We may be unable to offer the Service, or particular features or payment methods, in some countries because of the law that applies there, including sanctions and export control laws.
Unsend, edit and expiry
Unsend. You can reel in a message you have sent for as long as its string lasts, provided it has not been opened. The string lasts up to 30 minutes on Diamond and up to 2 hours on Delta and Festival, and you can choose a shorter default string (10 minutes, 30 minutes, 1 hour or 2 hours) within your plan’s limit. A message counts as opened when a recipient on Cometamail opens it, or when a recipient on another provider opens the secure link described in the section “Mail to other providers”. When you reel in a message, it is withdrawn from every recipient who has not opened it and returned to your drafts. If some recipients have already opened it, we withdraw it from the others and tell you who had already seen it.
Edit. For 24 hours after sending, on every plan, you can change the text of a message you have sent. Recipients who open the message after you edit it see the new version with a visible “edited” note, so that nobody is misled. You can always see your original wording, and previous versions are kept with the message until the message itself is deleted or expires. Editing does not change anything a recipient has already copied, printed, forwarded or quoted in a reply.
Expiry and taking back attachments. On Delta and Festival you can set a message to expire after one hour, one day, one week or on a date you choose, and you can take back an attachment by disabling the link to it. When a message expires or you reel it in, it disappears from the recipient’s Cometamail inbox, or its secure link stops working, and we delete its content from our active systems straight away and from our backups within 30 days. We keep only a record that the message existed (its sender, recipients, date and size), never its subject, body or attachments.
What we cannot control. These features act on the copies of your messages that we hold. We cannot recall or change copies that are outside our systems, including screenshots, photographs, printouts, downloads, forwards, quotations in replies made before a message was reeled in, edited or expired, copies kept by a recipient’s own provider, device or software, and the short preview described in the next section. You should therefore not rely on unsend, edit or expiry as a guarantee that a recipient will never see or keep what you sent. We make every reasonable effort to carry out your instructions promptly, and we are responsible to you where a failure to do so results from our own breach of these Terms.
Legal obligations. We must comply with orders of Spanish and EU courts and competent authorities. If we receive a valid legal order requiring us to preserve a specific message before it expires or is reeled in, we preserve it only to the extent and for as long as the order requires, and we tell you unless the law or the order prohibits us from doing so. You may not use unsend, edit or expiry to destroy evidence, to breach any legal duty to keep records, or to mislead anyone, as further described in our Acceptable Use Policy.
Mail to other providers
When you send a message to a recipient whose address is not hosted by Cometamail, that recipient receives an ordinary email from your address containing a short preview of your message and a secure link to the full message, which remains stored on our servers. This is what allows you to reel in, edit or expire messages sent outside Cometamail. The preview contains the subject and the opening lines of your message.
The preview is delivered to the recipient’s provider and, like any email, is stored in systems that we do not control. We cannot recall, edit or expire it. Please keep this in mind when writing the subject and first lines of a message that you may want to reel in later.
When a recipient opens the secure link, we record that it has been opened, so that we can tell you and know whether the message can still be reeled in. We do not use the link to track the recipient in any other way, we do not set cookies on their device and we do not record their location. How we handle the personal data of the people you write to is explained in our Privacy Policy.
Recipients on other providers can reply in the usual way, and their replies reach your Cometamail inbox as ordinary email. Messages you receive from people who do not use Cometamail are not affected by the unsend, edit or expiry features.
Your account and security
To use the Service you need an account. You agree to give accurate and complete information when you register, and to keep your recovery details, such as a recovery email address or phone number, up to date so that we can help you get back in if you lose access.
You can sign in with a password, with a passkey or, on Festival, through your organisation’s single sign-on. You are responsible for keeping your password, passkeys, recovery codes and the devices you use to sign in secure, and for activity under your account that results from your failure to do so. We recommend a strong, unique password and a passkey or second sign-in step. Do not share your sign-in details with anyone; if several people need access to the same mail, a Festival shared inbox is the right tool.
Tell us at once at help@cometamail.com if you believe someone else has accessed your account, or if your password or a device you use to sign in has been lost or stolen. We will help you secure your account and may ask you for information to confirm that you are its rightful owner. We will never ask you for your password.
Your @cometamail.com address is personal to you. You may not sell, rent or transfer it. We may refuse or withdraw addresses that impersonate another person, an organisation or Cometamail itself, or that are offensive. We never give an address that belonged to a closed account to anyone else, so that mail meant for you does not reach a stranger.
Festival teams and domains
Festival plans are bought by an organisation (the “Customer”) for its members, such as employees or collaborators. The Customer appoints one or more administrators, who can create, suspend and delete member accounts, reset sign-in methods, manage shared inboxes, set team expiry policies that may override a member’s own settings, configure single sign-on, and export, access or delete the mail and files in member accounts and shared inboxes, as permitted by law.
If you use Cometamail as a member of a Festival plan, your account is controlled by the Customer and the Customer’s own policies apply to your use of it. The Customer decides how member data is used: for that data the Customer is the controller and we act as its processor under article 28 of Regulation (EU) 2016/679 (the “GDPR”) and our Data Processing Addendum. Questions about how your organisation uses your account should be addressed to your administrator.
The Customer is responsible for its administrators and members complying with these Terms; for informing members about how their accounts are managed and monitored in accordance with applicable employment and data protection law, including article 87 of the LOPDGDD where it applies; and for any team expiry policy it sets, including making sure that the policy is consistent with any legal obligation it has to keep records.
Custom domains. On Delta and Festival you can use a domain name that you own or are authorised to use. You are responsible for registering and renewing the domain with your registrar and for keeping in place the DNS records we ask you to set. We are not your domain registrar. If your domain lapses, is transferred or its records change, mail to and from it may stop working, and we are not responsible for mail that cannot be delivered as a result.
Plans and payment
Prices. Delta costs $4 per month or $40 per year. Festival costs $6 per person per month or $60 per person per year. Prices are shown in US dollars. For consumers, the price shown includes any value added tax (VAT) or similar tax that applies where you live, and that is the price you pay. Business customers established in another EU country who give us a valid VAT number are invoiced without Spanish VAT under the reverse charge mechanism, as stated on the invoice. Your bank or card issuer may charge currency conversion or foreign transaction fees, which are outside our control.
Payment methods. We accept payment cards, Apple Pay and Google Pay. Festival customers paying yearly may also pay by bank transfer against an invoice, within the period stated on the invoice. Card and wallet payments are processed by our payment service provider; we do not store your full card number.
Free trial of Delta. You can try Delta free for 14 days, with no card required. At the end of the trial, your account simply returns to Diamond unless you choose to subscribe to Delta, and you are never charged without choosing a paid plan. If you return to Diamond, mail and features that exceed Diamond’s limits are handled as described under “Changing plans” below. Each person may use the free trial once.
Billing and renewal. Paid plans are billed in advance at the start of each monthly or yearly period and renew automatically for a period of the same length until you cancel. We tell you clearly about automatic renewal before you buy. For yearly plans, we email you at least 7 days before each renewal with its date and amount. You can turn off renewal at any time in Settings → Plan, and your plan then ends at the end of the period you have already paid for.
Changing plans. Upgrades take effect straight away, and we charge the difference for the rest of your current period on a pro rata basis. Downgrades take effect at the end of your current billing period. On Festival, members added during a period are charged pro rata for the rest of that period, and removing members takes effect from the next period. If you move to a plan with less storage than you are using, you keep all your existing mail, but new incoming mail may be returned to its senders until you are back under the limit, and we will warn you well before that happens. Messages you set to expire on a paid plan continue to expire as scheduled.
Failed payments. If a payment fails, we will tell you and try again over the following 14 days. If payment has still not been received after that, we may move your account to Diamond. You keep your mail and your address, but features and storage beyond Diamond’s limits are restricted until payment is made.
Price changes. We may change our prices for valid reasons, such as changes in our costs, in taxes or in the features we offer. We will tell you by email at least 30 days before a new price applies to you, and it will apply only from your first renewal after that notice. If you do not want to pay the new price, you can cancel before it takes effect, at no cost.
Withdrawal and refunds
Right of withdrawal. If you are a consumer, you have the right to withdraw from a contract for a paid plan within 14 calendar days of the day the contract is concluded, without giving any reason, in accordance with articles 102 to 108 of the consolidated text of the General Law for the Defence of Consumers and Users, approved by Royal Legislative Decree 1/2007 of 16 November (“TRLGDCU”). To exercise it, you must tell us of your decision by a clear statement before the period ends, by cancelling in Settings → Plan, or by writing to help@cometamail.com or to our postal address. You may use the standard withdrawal form set out in Annex B of the TRLGDCU, but you do not have to.
Because a paid plan starts straight away at your express request, if you withdraw from a monthly plan you pay only a proportionate amount for the days you used it before telling us, as permitted by article 108 of the TRLGDCU, and we refund the rest. A free trial does not start the withdrawal period; it starts when you choose to subscribe.
Our 14-day promise for yearly plans. In addition to your statutory rights, if you cancel a yearly plan within 14 days of paying for it, whether for your first year or a renewal, we refund the full amount you paid, without any deduction. This promise also applies to business customers.
How refunds are made. We make refunds without undue delay and in any event within 14 days of the day we are informed of your decision, using the same payment method you used unless you expressly agree otherwise, and at no cost to you. Refunds are made in US dollars, so the amount you receive in your own currency may differ slightly because of the exchange rate applied by your bank.
Cancelling at other times. After these periods, you can cancel at any time and your plan runs until the end of the period you have already paid for, after which your account moves to Diamond. We do not refund partial periods, except where these Terms or the law provide otherwise, for example if we stop providing the Service or make a change that you are entitled to reject.
Your content is yours
Your mail, attachments, contacts, files and any other content you create, send, receive or store through the Service (“Your Content”) belong to you or to the people who sent them to you. These Terms do not give us any ownership rights in Your Content.
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, index, back up, display and otherwise process Your Content, only to the extent necessary to provide, secure and support the Service for you, including delivering your messages, showing you your mail, searching it, filtering spam and malware, removing tracking pixels, and carrying out your instructions to reel in, edit or expire messages. This licence ends when Your Content is deleted from our systems, as described in these Terms and our Privacy Policy.
Our staff do not access Your Content, except where you ask us to (for example, to help with a support request, with your permission), where it is strictly necessary to investigate a specific report of abuse or a security threat to the Service, or where the law requires it. We never use Your Content for advertising, for profiling, or for any purpose unrelated to providing the Service to you.
You are responsible for Your Content. You confirm that you have the rights needed to send and store it, and that it does not break the law or our Acceptable Use Policy. If we receive a notice that content stored in or distributed through the Service is unlawful, including through a secure link shared with people outside Cometamail, we deal with it in accordance with Regulation (EU) 2022/2065 (the Digital Services Act) and the LSSI-CE, and we tell you what we have done and why, unless the law prevents us from doing so.
If you believe that content shared through a Cometamail link infringes your copyright or other rights, write to legal@cometamail.com with details of the work or right concerned, the link, and your contact details, and we will handle your notice promptly.
Acceptable use
You agree to use the Service lawfully and in accordance with our Acceptable Use Policy, which forms part of these Terms. In particular, you must not use the Service to send spam or commercial communications that breach article 21 of the LSSI-CE or any other law; to send phishing messages, scams or malware; to harass, threaten or abuse anyone; to impersonate any person or organisation; or to store or distribute unlawful content, including content that infringes the intellectual property or privacy rights of others.
You must not use unsend, edit or expiry to destroy evidence, to breach any legal or regulatory duty to keep records, or to mislead others, for example by editing a message to change what was agreed without telling the other side.
You must not interfere with or disrupt the Service or anyone’s use of it; test or probe its vulnerability except under a responsible disclosure arrangement agreed with us in writing; access or attempt to access accounts or data that are not yours; get around sending limits, storage limits or security measures; use scripts or other automated means to create accounts or send mail in bulk; or resell, sublicense or provide the Service to third parties, other than members of your own Festival plan, without our written permission.
Sending limits apply on every plan to protect the reputation of Cometamail addresses and keep mail flowing for everyone. They are set out in the Acceptable Use Policy.
Our property
The Service, including its software, apps, design, text and graphics, the Cometamail name, the kite and comet logos and our other trade marks, and all intellectual and industrial property rights in them, belong to Cometamail S.L. or its licensors and are protected by Spanish, EU and international law, including the consolidated text of the Intellectual Property Law approved by Royal Legislative Decree 1/1996 of 12 April and Law 17/2001 of 7 December on Trade Marks.
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable and revocable licence to use the Service for as long as your account is open. You may not copy, modify, distribute, sell or lease any part of the Service; decompile or reverse engineer it, except where the law expressly allows you to (for example, to achieve interoperability as permitted by article 100 of the Intellectual Property Law) and then only to that extent; or use our name or logos in a way that suggests we endorse you, without our written permission.
Some parts of our apps include open-source software, which is licensed to you under its own licence terms. Nothing in these Terms limits your rights under those licences.
If you send us feedback or suggestions, we may use them to improve the Service without any obligation to you, but we will not identify you publicly without your permission.
Privacy and your data
Cometamail S.L. is the controller of the personal data we process to provide the Service to you, except for data in Festival accounts, for which we act as processor on behalf of the Customer. How we collect, use, store and protect personal data, and how you can exercise your rights under the GDPR and the LOPDGDD, is explained in our Privacy Policy at cometamail.com/privacy. Our use of cookies is explained in our Cookie Policy at cometamail.com/cookies.
In short: we do not show ads, sell personal data or track you across the web; the content of your mail is processed only to provide the Service; and your data is stored in our data centres in València and Lisbon, encrypted at rest and in transit, and does not leave the European Economic Area except when you send a message to someone whose provider is elsewhere.
We respect the secrecy of communications protected by article 18.3 of the Spanish Constitution. We disclose personal data or Your Content to public authorities only when we are legally required to do so under a valid order issued in accordance with Spanish or EU law, and, where the law allows, we tell you before we do.
If you live in California or another US state with a consumer privacy law, our Privacy Policy explains the rights you have there. We do not sell or share personal information as those laws define it. Our Data Protection Officer can be contacted at privacy@cometamail.com.
Availability and changes
We aim to keep the Service available at all times and to supply it with reasonable care and skill. The Service depends on the internet, on other mail systems and on third-party networks, however, and it may occasionally be interrupted, for example for maintenance, updates, security measures or reasons beyond our reasonable control. We plan maintenance for quiet hours where possible and announce in advance planned work that is likely to affect you.
We deliver messages to other providers, but we cannot guarantee that they will accept them, place them in the recipient’s inbox rather than a spam folder, or deliver them within any particular time, since those systems are outside our control.
We keep improving Cometamail and may change or update the Service, for example to add features, to respond to changes in technology or the law, or to improve security. If you are a consumer, we make changes that are not needed to keep the Service in conformity with our contract only for a valid reason and at no extra cost to you. If a change will have more than a minor negative effect on your access to or use of the Service, we will tell you on a durable medium at least 30 days in advance, and you may end your contract free of charge within 30 days of the change taking effect, in which case we refund any amount you have paid for the period after the contract ends.
If you are a consumer, you benefit from the legal guarantee of conformity for digital services under the TRLGDCU throughout the period during which we supply the Service. If the Service is not in conformity with the contract, you are entitled to have it brought into conformity and, if that is not possible or is not done within a reasonable time, to a proportionate price reduction or to end the contract.
If we ever decide to stop providing the Service altogether, we will give you at least 90 days’ notice, keep your mail available for export during that time, and refund any amount you have paid for the period after the Service ends.
Liability and your rights
If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or of our failure to use reasonable care and skill. Loss is foreseeable if it is obvious that it will happen or if, at the time the contract was made, both you and we knew it might happen. We are not responsible for loss that is not foreseeable, for loss caused by events outside our reasonable control, or for business losses, since plans for consumers are provided for private use.
If you use the Service for business purposes, including under a Festival plan, then to the extent permitted by law we are not liable for indirect or consequential loss, or for loss of profit, revenue, business, goodwill or anticipated savings, and our total liability to you in any period of 12 months arising out of or in connection with these Terms is limited to the amount you paid us for the Service in that period or $100, whichever is greater.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for loss caused by our wilful misconduct or gross negligence, or for any other liability that cannot be excluded or limited under Spanish law, including the provisions of the TRLGDCU on unfair terms. Nothing in these Terms affects your statutory rights as a consumer.
The features that help you stay in control of your mail, such as unsend, edit, expiry, spam filtering and tracker blocking, act on the systems we operate, and as explained in the section “Unsend, edit and expiry” we are not responsible for copies of your messages held outside those systems. We are also not responsible for loss that you could have avoided by acting with ordinary care, for example by checking a recipient’s address before sending, and our liability is reduced to the extent that your own conduct contributed to a loss, in accordance with Spanish law.
Events outside our control. We are not responsible for failure or delay in performing our obligations caused by events beyond our reasonable control, such as natural disasters, epidemics, war, terrorism, civil unrest, acts of governments or authorities, failures of public networks or power supplies, or large-scale attacks on internet infrastructure. If such an event affects the Service, we will tell you, take reasonable steps to limit its effects and restore normal service as soon as possible. If the Service is unavailable for a prolonged period as a result, you may end your contract and receive a refund for any period you have paid for but not received.
We protect your data with care, including with backups in two locations. We still recommend that you keep your own copies of mail and files that are important to you; you can export all your data at any time in Settings → Export.
Indemnity
This section applies only if you use the Service for business purposes, including under a Festival plan. It does not apply to consumers.
You agree to indemnify Cometamail S.L. against claims, liabilities, fines, losses and reasonable costs, including reasonable legal fees, brought or imposed by third parties or authorities that arise from Your Content, from your or your members’ use of the Service in breach of these Terms or the Acceptable Use Policy, or from your infringement of any law or of the rights of any third party.
We will tell you promptly of any claim to which this indemnity applies, allow you to take part in or, where appropriate, take control of its defence, and not settle it without your consent, which you will not unreasonably withhold. We will take reasonable steps to limit our losses. You are not responsible under this section for claims to the extent that they are caused by our own breach of these Terms or our negligence.
Suspension and closure
Closing your account. You can close your account at any time in Settings → Account. Before you do, you can export all your mail, contacts and files in standard formats in Settings → Export. When you close your account, any paid plan ends at the end of the period you have paid for, unless you are entitled to a refund under the section “Withdrawal and refunds”. For 30 days after closure you can change your mind and reopen your account. After that, your mail and files are permanently deleted from our active systems, and from our backups within a further 30 days, except for information we must keep by law, as described in our Privacy Policy.
Suspension and termination by us. We may suspend or restrict your account, or end these Terms, if you seriously or repeatedly breach these Terms or the Acceptable Use Policy; if your account is being used for fraud, spam, malware or to harm others; if we are required to do so by law or by a competent authority; or if a payment for a paid plan remains outstanding after the steps described in the section “Plans and payment”. Our response will be proportionate, and where appropriate and lawful we will first warn you and give you a reasonable opportunity to put things right.
When we suspend, restrict or close an account, we tell you by email, using your recovery address where appropriate, with a clear statement of the reasons, the facts we relied on and how you can appeal, unless the law prevents us from doing so or doing so would compromise an investigation or the security of the Service or of other people. You can appeal by replying to that email or writing to abuse@cometamail.com, and a person who was not involved in the original decision will review it. If we close your account for a reason other than a serious breach, we give you at least 30 days to export your data first.
If we end these Terms without fault on your part, we refund any amount you have paid for the period after your account is closed. The sections of these Terms that by their nature should continue after the contract ends, including those on liability, indemnity and disputes, continue to apply.
Disputes and governing law
If you have a complaint, please write to help@cometamail.com or to our postal address. We will acknowledge it promptly and aim to resolve it as quickly as possible, and in any event we will reply within one month. Most problems are resolved this way, and an attempt to settle a dispute by negotiation may in any case be required under Spanish law before a claim can be brought before the courts.
If you are a consumer and are not satisfied with our response, you may take your complaint to the consumer affairs services of your municipality or autonomous community, or to an alternative dispute resolution entity accredited under Law 7/2017 of 2 November on alternative resolution of consumer disputes. We are willing to take part in consumer arbitration through the Spanish Consumer Arbitration System (Sistema Arbitral de Consumo) for disputes with consumers resident in Spain. Consumers resident elsewhere in the European Union can find accredited dispute resolution bodies, and free advice on cross-border disputes, through the European Consumer Centres Network.
These Terms, and any dispute or claim arising out of or in connection with them, are governed by Spanish law. If you are a consumer habitually resident in another country, you also keep the protection of the mandatory provisions of the law of that country, in accordance with Regulation (EC) No 593/2008 (Rome I).
If you are a consumer, you may bring proceedings in the courts of the place where you live, and we may only bring proceedings against you in those courts. If you use the Service for business purposes, the courts of the city of València have exclusive jurisdiction, unless the law provides otherwise.
Changes to these Terms
We may update these Terms to reflect changes in the Service, in the law or in our business, or to make them clearer. We only make changes for a valid reason, and we will not change the essential features of your plan or its price except as these Terms allow.
We will tell you about significant changes by email and in the Service at least 30 days before they take effect, explaining what is changing and why. If you do not agree, you can close your account or cancel your plan before the changes take effect, free of charge, and we will refund any amount you have paid for the period after that date. If you continue to use the Service after that date, the updated Terms apply to you.
Minor changes that do not reduce your rights, such as corrections and clarifications, and changes that are urgently required by law, may take effect when we publish them. The date at the top of these Terms shows when they were last updated, and previous versions are available on request.
Fine print and contact
Entire agreement. These Terms, together with the documents referred to in them, are the entire agreement between you and us about the Service and replace any earlier agreement on the same subject. They do not affect any statutory rights you have that cannot be changed by agreement.
Severability and waiver. If a court or authority decides that any provision of these Terms is invalid or unenforceable, the rest of the Terms remain in force, and the provision concerned is interpreted, as far as the law allows, in the way that best achieves its original purpose. If we do not insist straight away that you do something you are required to do, or delay taking action, that does not mean we have given up our rights.
Transfer. We may transfer our rights and obligations under these Terms to another company, for example as part of a merger or acquisition, provided that your rights under these Terms are not reduced. We will tell you in advance, and if you are a consumer and are unhappy with the transfer, you may end the contract and receive a refund for any period you have paid for but not used.
